In the state of California, a court order involving a divorce or family law case is often issued as final by the judge. In circumstances that require an alteration to a family court order or a request to appear, individuals must file a new case with the courts. Until further notice, they must adhere to the originally set legal terms until the court is able to adjust the court order accordingly with new information and requests.
Legal Adjustments and Amendments
The court has the final say in making any and all legal adjustments and amendments, regardless of whether both parties have come to an agreement on their proposed alterations. No actions or decisions are considered legally binding until they are officially considered and approved by the court.
San Diego Modifications to Family Court Orders
Generally speaking, modifications to family court orders revolve around the issues of child custody, visitation rights and child support. These areas are somewhat regularly altered after their initial issuance by the court, requiring adjustments based on case specifics. There are certain parameters within the California court system that indicates whether or not a change in a family court order is warranted or necessary. If deemed necessary or relevant, changes to a family court order will be made. If they are not seen as important, requests to modify will be dismissed.
Modifications to Child Support Payments
Life circumstances have a way of changing and as a result, often the financial well being of a parent will alter and impact their payments of child support. This change in finances can be either positive or negative, with an increased salary or a dramatic loss of income. Irrefutable proof is required on behalf of the party requesting a modification to a court order before such changes will be approved by the court. In requesting a change to a court order, clear proof of altered circumstances is necessary.

I wanted to take the time to write a review, as I was so impressed with Stephen Smith's representation of me and my custody case in San Diego. I had an exceptionally difficult split with my ex that involved custody over our newborn daughter, multiple police reports, a DVRO, and a move 600 miles away from the scenario. Despite the twists and turns of my ex having a completely FREE attorney and being 12 years older than me, Stephen won my case and kept me sane during a year long custody battle that was nothing short of ugly most of the time. He guided me through two TRO's, mediation, multiple court appearances, handled in person appearances without me whenever he could so I didn't have to fly from San Francisco to San Diego, and settled my case out of court completely in my favor. Not only did he get me FULL physical custody of my daughter, but also FULL legal custody, supervised visitation for 6 months at only 6 hours at a time twice a month in northern California, and a child support amount well over what was expected. I was very happy with the results, and a year long emotionally draining nightmare was handled by him with the utmost professionalism and caring demeanor. I can't imagine having gone through that period of time with another attorney who could navigate all of the random pieces that arose and complicated matters for my case. He reassured me that my life could be normal again and was the deciding factor in this becoming a reality. Given that custody court is one of the most stressful and terrible things that anyone could go through, it is essential to have a good attorney by your side that you can count on and trust... and I feel that Stephen exceeded my expectations when it came to the outcome of my case as well as the support he provided me when everything was falling apart. Thanks to Stephen, my daughter and I were able to stay together full time, move to northern California to have my family's support during my breakup, and life a peaceful life with all of the drama behind us!
Let me begin by saying, my situation when I contacted Dunne and Dunne, seemed hopeless. My case involved a very complicated custody matter. There was no attorney, that would accept my case. Either because it was too complicated, or because they wanted a huge retainer. So after calling about a couple dozen or so attorneys,I reached Dunne and Dunne.
Stephen Smith, took the time to listen to meand the circumstances. He began to immediately work on my case, with due diligence. He ended up winning my case!. He has been with me every step of the way , and he has followed though with everything he said he would do .Without him, there would have been no way I could have won. He is a very accomplished, sharp, intelligent five star attorney. Thank you Dunne and Dunne! I would highly recommend him to anyone.
My divorce was well into the second year when my son had insisted that I go meet Mr. Dunne. I really felt defeated and was very angry at the court system. Mr. Dunne literally did more in two months then my other two attorneys did in over two years. What a relief to finally find someone who actually cared about my case. If you have an ex who wants to make your divorce as difficult as possible, then you need someone very tough and experienced. Yes, he does respond to phone calls and emails unlike what the other two reviews would have you believe. He is extremely professional and articulate. Mr. Dunne is absolutely the best.
My wife was not letting me see my kids, ages 2 and 7 months. She told the court so many lies about me and made me look unfit. I didn't know what to do. We are not even divorced, just separated so she is very jealous and will go to any lengths to make my life miserable. I contacted Dunne & Dunne and boy did things change fast. Mr. Dunne was very aggressive and determined to get me visitation. I now share custody (50/50) with her and that is all I wanted all along. Thanks Mr. Dunne.
Mr. Anthony Dunne went above and beyond! Having to go through a divorce is hard and the last thing you want is to worry about all the paper work that comes with it. Everything was taken care of and any questions I had along the way were welcomed. Choosing to go with Dunne& Dunne was a smart move, wish I could say the same for my ex.
Thank you so much
Anthony Dunne has been my lawyer for five years. My case has been very difficult and high conflict. Mr. Dunne has stuck by me the entire time. Mr. Dunne obtained nearly 100% custody for me and resolved my financial issues in my favor. His trial skills are unmatched, and the opposing lawyer admitted to the judge that I have the better trial attorney! Do not hire anyone else, Mr. Dunne is the best.
I was incredibly timid when I met Tony Dunne. While I wanted to do what was best for my children, I was very afraid to go to court to pursue child support and visit child custody issues. Tony reassured me every step of the way. He provided excellent guidance and counsel and was very responsive. Perhaps the best experience for me was watching Tony Dunne in the courtroom. I have honestly never been more nervous in my life, but Tony took control and fought so hard and so naturally for me. In him, I knew I had a true advocate. The outcome of my case was positive and my children and I are living a better life because of Tony. I highly recommend hiring Tony Dunne as your family law attorney.
Our society loves to make "lawyer jokes" that portray all lawyers as unscrupulous, sleazy, heartless, and greedy. If you are looking for such a lawyer, Jim Dunne is not your man.
Going through a divorce is a painful experience, but Jim was by my side every step of the way. If you ask me about my lawyer, I will answer with the words caring,
compassionate, professional, experienced, a person of integrity, excellent communicator, gracious and diplomatic in the court room. He knows how to work with judges and other lawyers to bring about the best possible results for his client.
I am honored to have such a skilled lawyer and even more honored to be able to call him my friend.
My case was complicated from the very start. My ex was extremely hostile and very good at "using the system." I needed a lawyer who was very knowledgeable, intelligent (to match wits with the "top gun" lawyer my ex hired), and not afraid to challenge the entrenched psychological contingent. Jim Dunne was actually recommended to me by one of the top lawyers, in family law, who I was forced to abandon because of a legal conflict. As it turned out, this was the best thing that ever happened to me.
Jim and Tony, as well as all the lawyers and staff they employ, are as ethical a group as can be found. I am very pleased with their consistent effort and recommend them, without hesitation, as often as I hear of a need. I am delighted to offer my own testimonial to the others who, I am sure, think the world of them
We have used Dunne & Dunne for a couple of years now, in a protracted and difficult child custody and visitation case. Every single person that we've ever dealt with in their office has been professional, and clearly a caring, decent human being. They take their work very seriously, as well as their obligations to their clients. They are always well-prepared, aggressive, and yet ethical in court.
After hearings, I have repeatedly had people in the audience ask me for my attorney's contact information, because they have been impressed with how competent they are. We feel very fortunate to have the quality of representation Dunne & Dunne, LLP provides, and recommend them without hesitation to anyone needing family law help.
