Divorce is not only an emotional process, but it’s also one filled with paperwork – a lot of it. The legal to-do’s can be confusing if you’re attempting to manage it on your own.
“ONE-DAY DIVORCE” PROGRAM
But San Diego Superior Court’s “One-Day Divorce” program is hise ease the process, said Supervising Judge of the Family Court, Maureen Hallahan.
“It’s a difficult and emotional process anyway to go through a divorce, but we don’t want to add anxiety and stress to the process by them not being able to do the correct paperwork,” Hallahan said.
The program is available for San Diego county residents who meet at least one of the following requirements: aren’t being represented by an attorney, have filed for divorce (at least 6 months prior), and are ready for the final step of the process: the judgment. Because most of the process is already complete, spouse’s seeking the program should have already settled on property and debt division, alimony and, if there are children involved, a parenting plan.
If these requirements are met, the couple sets up an appointment, and in the span of 30 minutes to a couple of hours, they walk out with a finalized divorce.
LONGER THAN 6 MONTHS
“One-day” might be a bit of a misnomer due to the fact that in California, the divorce process takes a minimum of 6 months. But for those who do not have legal representation, divorce can take much longer than 6 months.
“I chat with the One-Day Divorce folks when they come in and always ask them how long have you been trying (to divorce) and a year is on the shorter time,” said Judge Michael Groch, who presides over several one-day divorces per day.
This not only makes the process more stressful, but also bogs down the court system that is already overladen. “One of the biggest complaints about courts, and family courts in particular, is that the process takes too long to complete,” said the supervising judge, Hallahan. “The ‘One-Day Divorce’ program was created to help solve these problems.”
SIMILAR PROGRAMS THROUGHOUT CALIFORNIA
Sacramento also has a similar program. San Diego’s program was modeled after that one, and is being funded for three years via a grant from the San Diego County Bar Foundation.
